Agent Terms and Conditions

These Agent Terms and Conditions apply when an agent creates an account, accesses showing opportunities, or accepts a showing request through Showings Made Simple. By accepting these terms, the agent agrees to the following conditions.
1. Independent Contractor Status
Agents who use Showings Made Simple perform showing services as independent contractors. Nothing in these terms creates an employment relationship, partnership, joint venture, franchise, or agency relationship between an agent and Showings Made Simple. Agents are responsible for their own licenses, insurance, taxes, expenses, and compliance with applicable laws, regulations, brokerage policies, and professional obligations.
2. Limited Showing Role
When an agent accepts a showing request, the agent's role is limited to providing access to the requested property and conducting the showing professionally, safely, and in accordance with applicable rules. The agent is not being retained through the platform to provide broader real estate representation, advice, negotiations, transaction management, or other brokerage services unless the agent and buyer separately agree to those services outside the showing request.
3. No Buyer Agency Unless Separately Agreed
Accepting or performing a showing request does not create a buyer-agency, representation, fiduciary, or exclusive relationship between the showing agent and the buyer. Any buyer-agency or representation relationship must be established separately through an agreement that complies with applicable law and brokerage requirements.
4. No Circumvention
Agents may not use a showing request, buyer introduction, or information obtained through Showings Made Simple to avoid, bypass, or circumvent the platform's referral obligations. Agents must not structure, redirect, conceal, or delay a transaction for the purpose of avoiding the referral fee described in these terms.
5. Referral Fee
If an agent, the agent's brokerage, or another person or entity working with the agent completes a purchase transaction with a buyer introduced through Showings Made Simple, Showings Made Simple is entitled to a referral fee equal to 0.25% of the final sale price, payable upon successful closing.
6. 24-Month Protection Period
The referral-fee and non-circumvention obligations apply to a transaction involving an introduced buyer that closes during the 24 months after the agent first receives or accepts the buyer's showing request through Showings Made Simple. These obligations continue during that protection period even if the agent later stops using the platform. If the buyer later requests representation through Showings Made Simple and the agent accepts that representation, the referral terms governing the agent's representation of that buyer shall be governed by the more specific Offer Representation Agreement. Under that agreement, a twelve (12) month referral period begins on the date the agent accepts representation and applies to any covered transaction involving that buyer during that twelve-month period.
7. Agent Subscription Authorization
I authorize Showings Made Simple LLC to securely store my payment method and automatically charge $5.99 per month beginning after my free 3-month trial unless I cancel my subscription. I understand that maintaining an active subscription is required to continue receiving showing opportunities.
8. Suspension and Termination
Showings Made Simple may suspend, restrict, or terminate an agent's access to the platform for a violation of these terms, nonpayment of amounts due, unsafe or unprofessional conduct, licensing or compliance concerns, misuse of platform information, or conduct that may harm buyers, other users, or the platform. Suspension or termination does not eliminate obligations that arose before access ended or that are intended to survive termination.
